Minnesota’s, “36-hour rule” requires that an adult arrested without a warrant must be brought before a judge within 36 hours of their arrest, not including the day of the arrest, Sundays, and legal holidays. This rule ensures that individuals do not remain in custody indefinitely without legal oversight and must be released if they are not brought before a judge within this period.
