What is a conditional bail bond?

  • A judge can set a conditional bail bond as a way to ensure a defendant’s appearance in court and public safety. 
  • It is a way for a defendant to be released from jail by agreeing to specific rules or “conditions”. 
  • If the defendant follows all the conditions, the bail is refunded at the end of the case (minus fees). 
  • If the defendant violates any conditions, the bond is forfeited, and they can be rearrested. 

Examples of common conditions:

  • Abstaining from alcohol or drug use
  • Submitting to random drug and alcohol testing
  • Wearing an electronic alcohol monitor
  • Surrendering passports to prevent travel
  • Staying away from the alleged victim or specific locations
  • Home detention
  • Regular check-ins with a pretrial services officer
